Nadia  P. Bermudez and Greg A. Garbacz, Patrick J. Goode II’s chapter, “Voir Dire and Opening Statement: Defense Perspective” appears in the Sexual Harassment and Retaliation handbook, an official publication of the American Bar Association.

SAN DIEGO, CALIFORNIA – Klinedinst is pleased to announce that the American Bar Association, one of the world’s largest voluntary professional organizations, with over 40,0000 members and more than 3,500 entities, selected Klinedinst attorneys to author a portion of their handbook on Sexual Harassment and Retaliation. This important new treatise provides practical guidance for employment law practitioners, including outlining best practices for handling claims involving sexual harassment and retaliation.

Klinedinst’s Nadia P. Bermudez and Greg A. Garbacz, as well as Patrick J. Goode II were selected for their experience in employment litigation, sexual harassment, discrimination, and other employment topics. Their chapter titled “Voir Dire and Opening Statement: Defense Perspective” is a detailed guide to strategic considerations for voir dire and opening statements in harassment and retaliation cases.  In the chapter, the authors discuss a defense-oriented approach to juror selection, along with integrating defense-oriented themes into opening statements to avoid prejudice and bias against employers.

In the chapter, the authors discuss a defense-oriented process by which prospective jurors are examined, selected, and presented with opening statements that are imperative to sexual harassment cases. They analyze how voir dire is a window into the biases of potential jurors who may have prejudices against the employers.

LA JOLLA, CALIFORNIA – Klinedinst Founder and CEO John D. Klinedinst has just been named a 2019 Most Admired CEO by the San Diego Business Journal. The award, recognizing John’s stewardship in the medium-sized private company category, was announced June 19, 2019 at a special ceremony held on the La Jolla campus National University.

The Most Admired CEO Award distinguishes chief executives who have a strong vision for their companies, have shown commitment to culture in the workplace, and have made significant contributions to the San Diego community.

“John is absolutely deserving of this recognition,” said Arthur Moreau, III, who serves as Chief Operating Officer for Klinedinst PC. “John is a visionary leader who believes in the power of the individual. He truly leads by example, and puts his business background to work every day for the benefit of our employees, our partners, and our clients.”

Each year, the San Diego Business Journal receives submissions of Chief Executive Officers who lead businesses, grow revenue, create jobs and provide products and services that boost the region’s economy. The San Diego Business Journal then evaluates all submissions and publishes its list of finalists for the award.

Of the dozens of finalists named this year from the business community, only six law firms had CEOs or managing partners that made it through to the finalist round. In recognition for their contributions and accomplishments, every one of the finalists was recognized at the awards ceremony before the winners in each category were announced.

“This is such an incredible and completely unexpected honor,” said Klinedinst. “I have been fortunate enough to be in the right place, at the right time. I’m very honored, humbled and proud to be a part of this amazing group of team members and the great work they do, day-in and day-out. My thanks to the San Diego Business Journal for highlighting our amazing business community, and to all of the CEOs making this a terrific place for business to happen.”

The Navy’s 33rd Bay Bridge Run/Walk begins between the Convention Center and the Hilton San Diego Bayfront, goes across the Coronado Bridge, ending in the scenic Tidelands Park.

SAN DIEGO, CALIFORNIA – Klinedinst was proud to sponsor and participate in the Navy’s 33rd Annual Bay Bridge Run/Walk on Sunday, May 19, 2019. The Bay Bridge Run/Walk brings people from across the nation to participate in this remarkable event. Every year, the event draws in roughly 10,000 people to enjoy the course, panoramic views, and post-run celebration. The course is a unique 4-mile run/walk, which begins near the 10th Avenue Marine Terminal in downtown San Diego, continued over the iconic Coronado Bay Bridge, and finishes at Coronado’s Tidelands Park.

This year’s event has partnered with the Navy Gold Star Program, which honors surviving family members who lost their life on active duty. To show appreciation, the Program created the “I Run to Remember” campaign to pay tribute to those lost where participants can write the name of a Fallen Service Member on their bib in remembrance. The Navy Gold Star (NGS) is a Survivor assistance program designed for Families of Service Members who passed while on active duty and provides long-term assistance and support to Survivors.

“To honor our military and show support, Klinedinst is proud to sponsor once again the Navy’s Bay Bridge Run/Walk in support of MWR,” said Arthur Moreau, Chief Operating Officer of Klinedinst and a former naval aviator. “Every year, North Island’s MWR always does a fantastic job making the iconic bridge into an active pedestrian course, and we are all excited to participate again.”

SAN DIEGO, CA – Klinedinst is proud to announce that Shareholder Robert M. Shaughnessy has been officially named a Certified Specialist in Appellate Law by the State Bar of California Board of Legal Specialization.

Robert M. Shaughnessy

An attorney with over two decades of experience, Mr. Shaughnessy regularly counsels clients on appellate and writ review proceedings in various litigation matters. Areas of practice include business litigation, unfair competition, false advertising, trade secret misappropriation, employment issues, invasion of privacy, director and officer liability, real property law, breach of fiduciary duty, and professional liability claims.

Mr. Shaughnessy has received numerous accolades previously, including Martindale-Hubbell’s highest AV®-Preeminent™ peer review rating. Martindale-Hubbell has been recognizing lawyers for their strong legal ability and high ethical standards for more than a century. Shaughnessy also was honored in 2019 in San Diego Super Lawyers® magazine. Fewer than 5% of attorneys in California are ever featured, and the lawyers included are chosen by their peers as being the very best in the profession.

State Bar of California, California Board of Legal Specialization

The process of becoming a certified specialist in a particular field of law is a significant one. Attorneys identified as certified specialists by the State Bar of California Board of Legal Specialization have passed a written examination, demonstrated a high level of experience in the specialty field, fulfilled ongoing education requirements, and been favorably evaluated by other attorneys and judges familiar with their work.

The designation of Certified Specialist in Appellate Law is rare. Of the 266,000 attorneys licensed to practice in California, roughly 0.11% have achieved the Certified Specialist in Appellate Law designation. On a local level, less than 40 attorneys in the entire San Diego region have earned the designation. Klinedinst one of the few firms in San Diego and Imperial counties to have multiple Certified Law Specialists in its appellate group.

“This is an incredible achievement for Rob, as well as our outstanding appellate group,” said John Klinedinst, Founder and CEO who is also a Certified Specialist in Legal Malpractice Law. “While the certification process is a lengthy one, it helps identify the very best of the best in any legal specialization. Rob is one of the very best appellate lawyers I have ever seen in action, and truly deserving of the certification. Together with Dale and the other members of our appeals group, we have a powerful and accomplished appellate team ready to help clients ensure their interests are preserved and protected .”

In addition to his practice, Mr. Shaughnessy is active in the community having recently completed a one year term as Chair of the San Diego County Bar Association’s (SDCBA) Appellate Practice Section. Mr. Shaughnessy is also an appellate attorney volunteer for pro per appellants and provides procedural guidance to self-represented appellants and respondents through the SDCBA sponsored Civil Appellate Self-Help Workshop. He is a founding member of the San Diego Appellate Inn of Court, and serves as Co-Chair of the Civility Committee for the San Diego Chapter of the Association of Business Trial Lawyers (ABTL). Outside of the legal community, Mr. Shaughnessy serves as Board Member to No Limits Limb Loss Foundation and is a member of several non-profit organizations.

Mr. Shaughnessy earned his Juris Doctor from the California Western School of Law, where he graduated in the top 15th percentile of his class. He graduated cum laude with a Bachelor of Arts degree in Communication from California State University, San Bernardino.

Klinedinst congratulates Mr. Shaughnessy on this tremendous achievement. To learn more about his background, please visit:

SACRAMENTO, CALaw360, a nationally-recognized source for legal news, has published an article by W. Jason Scott and Ian A. Rambarran on a new appellate ruling that may be a game changer for lenders doing business in California.

The article focuses California’s Fifth Appellate District, which recently published its decision in Hardie v. Nationstar Mortgage LLC that ruled lenders and servicers are subject to claims of attorney’s fees should a borrower obtain a temporary restraining order (TRO) enjoining a foreclosure sale.

In their published piece, Mr. Scott and Mr. Rambarran write about this teutonic shift in the law, which had previously held that fees were recoverable only at the preliminary injunction phase. The Hardie ruling now forces lenders and servicers to retain counsel and litigate a claim within a shortened notice period of no less than 24 hours’ notice. Otherwise, lenders and loan services could be liable for attorney’s fees incurred by the borrower to bring the TRO.
