The process of becoming a certified specialist in a particular field of law is a significant one. Attorneys identified as certified specialists by the State Bar of California Board of Legal Specialization have passed a written examination, demonstrated a high level of experience in the specialty field, fulfilled ongoing education requirements, and been favorably evaluated by other attorneys and judges familiar with their work. 

The designation of Certified Specialist in Appellate Law is rare. Of the 266,000 attorneys licensed to practice in California, roughly 0.11% have achieved the Certified Specialist in Appellate Law designation. On a local level, less than 40 attorneys in the entire San Diego region have earned the designation. Klinedinst one of the few firms in San Diego and Imperial counties to have multiple Certified Law Specialists in its appellate group.

Mr. Shaughnessy is also an appellate attorney volunteer for pro per appellants and provides procedural guidance to self-represented appellants and respondents through the SDCBA sponsored Civil Appellate Self-Help Workshop. He is a founding member of the San Diego Appellate Inn of Court, and serves as Co-Chair of the Civility Committee for the San Diego Chapter of the Association of Business Trial Lawyers (ABTL). Outside of the legal community, Mr. Shaughnessy serves as Board Member to No Limits Limb Loss Foundation and is a member of several non-profit organizations.

SACRAMENTO, CALaw360, a nationally-recognized source for legal news, has published an article by W. Jason Scott and Ian A. Rambarran on a new appellate ruling that may be a game changer for lenders doing business in California.

The article focuses California’s Fifth Appellate District, which recently published its decision in Hardie v. Nationstar Mortgage LLC that ruled lenders and servicers are subject to claims of attorney’s fees should a borrower obtain a temporary restraining order (TRO) enjoining a foreclosure sale.

In their published piece, Mr. Scott and Mr. Rambarran write about this teutonic shift in the law, which had previously held that fees were recoverable only at the preliminary injunction phase. The Hardie ruling now forces lenders and servicers to retain counsel and litigate a claim within a shortened notice period of no less than 24 hours’ notice. Otherwise, lenders and loan services could be liable for attorney’s fees incurred by the borrower to bring the TRO.

Emily F. Burdine has joined Klinedinst’s Santa Ana office as an associate, with a focus on business litigation.

Ms. Burdine is a well-versed litigator having managed the process from inception through resolution. She has represented financial institutions and other business entities in complex business litigation involving claims such as breach of contract, fraud, and unfair competition in state and federal courts. Ms. Burdine has successfully defended a federal action through appeal and drafted an answering brief resulting in the Ninth Circuit Court of Appeals affirming the orders of the district court.
